Race DiscriminationRacial discrimination still exists in many workplaces even though, during the past 15 years, evidence of bias has generally become more subtle than in earlier years. While offensive remarks are not as common, some employees still face racially hostile work environments. Our clients also face glass ceilings, criticisms based on stereotypes rather than reality, denial of promotions, unfair terminations and other treatment that is different from their peers. Although our largest race discrimination cases have involved representation of African American employees, Sprenger + Lang has represented Hispanic employees as well, and will bring class action cases on behalf of persons of any race. What is important to a race discrimination case is the presence of enough protected employees in the workforce to make a class action effective. Of course, if an employer doesn't hire protected class members in a number proportionate to the pool of available workers, then a class action based on hiring may be possible. Employees also may have claims based on what is called "national origin" (for example, Mexican, Saudi Arabian, or Somali employees).
